Welcome to PacePilot

Before you begin your personal running journey, please take the time to read these terms and conditions carefully. They are important because they govern the relationship between you and Pace Pilot AS—and therefore affect your legal rights and obligations.

Privacy Policy

1. Introduction

This privacy policy explains how we at Pace Pilot process your personal data when you use our training app. Pace Pilot AS (org. no. 933010201) is the data controller for all processing of your personal data where we determine the purpose of the processing and the means used for that processing.

2. What information we collect

We collect the following types of information about you:

  • Personal information: Name, gender, year of birth, email address, phone number (Vipps), and payment information (third party: Stripe).
  • Training data: Training history, performance, GPS data, and other training-related information from you, Strava, Polar, Suunto, or Garmin.
  • Health data: Heart rate data from Strava, Polar, Suunto, or Garmin. Heart rate is necessary for the Service: we use it to assess your performance and development and to build and adjust your training plan. You give explicit consent to this when you connect your watch or training service, and the app cannot deliver a training plan without it.
  • Health data: Sleep, HRV, stress, and Vo2Max from Garmin and Apple, only after your separate explicit consent in the app. These are optional and off by default.
  • AI coach data: The messages you write to the AI coach and the training data we send with them to generate answers, training programs, and proactive coaching messages.
  • Technical information: IP addresses, device and browser information, and campaign or click identifiers when you arrive via an advertising link (AppsFlyer OneLink).
  • Usage data: Operating system version, a PacePilot-generated identifier, and which screen you are on in the app, used to understand how the app is used.

3. How we collect information

We collect information in various ways, including:

  • Directly from you when you register, pay for the service, or use the app.
  • Through connections to third-party platforms such as Strava, which you voluntarily link to our app.
  • Through the AI chatbot feature, which you voluntarily interact with.
  • Through advertising links (OneLink) when you click an ad and are redirected to the App Store or Google Play.
  • Through the app itself, which records basic usage data as described in section 2.

4. How we use the information

The information we collect about you is used to:

  • Provide and further develop our services (legal basis: performance of the contract with you, and our legitimate interest in developing the app).
  • Personalize the user experience based on your training habits (contract).
  • Develop and offer customized running training programs using artificial intelligence (AI) based on your own training data, heart rate measurements, and AI chatbot conversations (contract, with your explicit consent for health data).
  • Proactively notify you in the app when your training is off course or your recovery data (for example poor sleep) suggests you should avoid hard training, if you have consented to sharing optional health data (explicit consent). You can turn these messages off in the app settings.
  • Manage your subscription and payment information (contract, and our legal obligation to keep accounting records).
  • Communicate with you about updates and other relevant information (contract).
  • Understand how the app is used, through anonymised funnel analyses based on the usage data in section 2 (legitimate interest).
  • Keep the Service secure and fix technical errors (legitimate interest).
  • Measure which advertisements led to app install, trial, and purchase, and share that with the advertising platforms listed in section 5, only when you have consented to ad tracking in the app (consent).

5. Sharing of information

We do not share your personal information with third parties except:

  • When necessary to deliver the service.
  • When we have your explicit permission.
  • When required by law.

We require everyone we share your personal data with to safeguard your data in accordance with the requirements of the GDPR. We enter into data processing agreements with everyone who processes data on our behalf where required. Where a provider processes data outside the EEA, the transfer is based on the EU–US Data Privacy Framework or the EU Standard Contractual Clauses, as stated below.

We take security and your privacy seriously and use appropriate technical and organizational measures to protect against unauthorized access, alteration, disclosure, or destruction.

6a. How long we keep your data

  • Account, training data, health data, and AI coach conversations: as long as your account is active. You can delete individual AI coach conversations at any time. Everything is deleted when you delete your account.

7. Your rights

You have a number of rights regarding the processing of your personal data. These rights include:

  • Access: You have the right to request access to what personal data we hold about you.
  • Rectification: You have the right to request correction of inaccurate or incomplete personal data.
  • Erasure: You have the right to request deletion of your personal data. This does not apply if there are lawful grounds for continued processing.
  • Restriction of processing: In certain cases, you have the right to request that we restrict the processing of your personal data.
  • Data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, and you have the right to transfer that data to another controller where technically feasible. This applies only to data you have provided and that is processed automatically based on your consent or to perform a contract.
  • Object: You have the right to object to our processing of your personal data when processing is based on our tasks or on a balancing of interests.
  • Automated decisions: You have the right not to be subject to a decision based solely on automated processing, including profiling, if it has legal consequences for you or significantly affects you. This does not apply if the decision is necessary to enter into or perform a contract between you and us, is based on your consent, or is otherwise permitted by law.
  • Withdrawal of consent: If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before withdrawal.

If you wish to exercise any of these rights, please contact us. We will respond to your request as soon as possible and no later than one month after we receive it. In complex cases this may be extended by up to two months, in which case we will let you know. You may also complain to the Norwegian Data Protection Authority (Datatilsynet).

8. Changes to our privacy policy

We reserve the right to update this privacy policy as needed. Any changes will be published on our website and you will be informed by email or other appropriate channels.

9. Contact information

If you have questions about this privacy policy or your personal data, please contact us at:

10. Use of email address for marketing

10.1 Purpose

We would like to keep you updated on our services, news, offers, and activities. If you consent to this, we will use your email address to send newsletters, promotional offers, and other information about our products and services.

10.2 Legal basis

The right to send you marketing by email requires consent, unless otherwise provided by applicable marketing law (for example, “soft opt-in” if you are already a customer and the legal conditions are met). By checking a box or otherwise explicitly giving consent when you register, you confirm that we may contact you electronically for marketing purposes.

If you do not wish to receive marketing, you may choose not to give consent. You may withdraw any consent you have given at any time.

10.3 What data is processed?

  • Email address: Used to send marketing communications.
  • Usage data: In some cases we may also use aggregated analyses or pseudonymized data from your use of our services to evaluate advertising effectiveness or create more accurate ads.

10.4 Sharing with third parties

We do not share email addresses or other personal data with third parties for their own purposes unless otherwise stated in this privacy policy or you have given separate consent. We do not upload your email address to social media or advertising platforms.

10.5 How long do we store your data?

The data is retained as long as you have an active relationship with us (subscription/customer/user) or until you withdraw consent. Upon withdrawal of consent, we will delete or anonymize your email address for marketing purposes, unless we have another lawful basis for further retention.

10.6 Opt-out and withdrawal of consent

  • You may unsubscribe from newsletters/marketing at any time by clicking the unsubscribe link at the bottom of emails you receive from us, or by contacting us directly.
  • You may object to the processing of your personal data for direct marketing under GDPR Article 21.
  • If you have consented to receive marketing, this consent may be withdrawn at any time by contacting us at **post@pacepilot.no**. Withdrawal of consent does not affect the lawfulness of processing that took place before consent was withdrawn.

11. Consent

We ask for your consent separately in the app, and never as a condition of accepting these terms:

  • Heart rate: Explicit consent when you connect your watch or training service. Heart rate is necessary for the Service, so the app cannot deliver a training plan without it.
  • Optional health data (sleep, HRV, stress, Vo2Max): Separate explicit consent in the app. Off by default.
  • Ad tracking: Separate consent in the app. AppsFlyer is only activated, and advertising platforms only receive data, after you have said yes. On iPhone, Apple's tracking permission is also required.
  • Email marketing: Consent at registration or later, see section 10.

You can change or withdraw each consent at any time in the app settings. Withdrawing consent to ad tracking stops all sharing with advertising platforms from that moment.

12. Cookies on our website

Our website does not use advertising or analytics cookies or tracking scripts. Only cookies that are strictly necessary to deliver the website are used.

3. Subscriptions from PacePilot

3.1. Subscription types

Pace Pilot offers various subscriptions with different commitment periods (“Subscription”). Our standard subscriptions have a monthly price ranging from NOK 99 to NOK 149 (subject to change). Certain promotional offers may differ in price for a limited period. Which subscriptions are available to you at any time is shown on our websites and/or in the “PacePilot” app.

3.2. Purchasing a subscription

You may purchase a Subscription directly from us via our website or app. Available purchase options may vary depending on device type, among other factors. Subscription content and functionality may change over time, for example if we change or improve the Service or to comply with legal requirements. If a change has a negative effect on your Subscription, you will be notified and may cancel the Subscription before the change takes effect.

3.3. Switching subscription types

If you wish to switch to another Subscription, you may do so by contacting us or by adjusting the subscription under account settings at www.pacepilot.no or in the app. If you switch Subscription before the end of the current billing period, any price adjustments may take effect immediately or at the next billing, depending on what is agreed.

3.4. Multiple users / households

Pace Pilot currently primarily offers Subscriptions for individuals, but we may launch multi-user solutions in the future. Information about any family or multi-user options will then appear on our websites. If such a Subscription becomes available, the person who pays for the Subscription (administrator) may invite others in the household to use the Service.

4. Trial periods and promotional offers

4.1. Trial periods

We may in some cases offer a free or discounted trial period (“Trial Period”) for new users so you can test the Service. As a general rule, each person may only use one Trial Period. PacePilot determines at its discretion whether you qualify for a Trial Period. If we detect abuse (e.g. creating multiple accounts with different email addresses), we reserve the right to end or limit access to the Trial Period.

4.2. Promotional offers

In addition to Trial Periods, we may offer other temporary promotions. Unless otherwise specified, promotional offers apply only to new customers. You will be charged the regular price when the promotional period ends unless you cancel the Subscription before the promotional period ends.

5. Fees and payment

5.1. Price

Current prices for your Subscription are shown at www.pacepilot.no and/or in the app. Our prices may change over time, for example due to inflation, expansion of the Service, or increased costs related to rights or technical operations. If a price change affects you, you will be notified at least 30 days in advance so you have time to cancel the Subscription before the price change takes effect.

5.2. Billing period

You are charged in advance for each billing period (usually monthly) from the purchase date or from when a free Trial Period, if any, ends. If you change Subscription, the new price applies from the next billing date unless otherwise agreed.

5.3. Payment methods

You may update your payment method under “My account” at www.pacepilot.no. PacePilot may at any time reject or block certain credit cards or payment methods for various reasons. If you purchased a Subscription through a third party (e.g. an app store), the third party’s payment terms apply.

5.4. Failed payment

If payment cannot be completed (for example due to an expired card), your access to the Service may be temporarily suspended until you update your payment information.

6. Right of withdrawal, cancellation, and notice period

6.1. Right of withdrawal

As a consumer, you have a 14-day right of withdrawal under Norwegian consumer withdrawal legislation. The withdrawal period runs from the purchase date. To use the right of withdrawal, you must clearly notify us within 14 days. You may use the withdrawal form at the bottom of these Terms or send an email to post@pacepilot.no. If you use the right of withdrawal, the Subscription ends immediately and we will refund your payment without undue delay. We may however deduct an amount corresponding to your actual use of the Service during the withdrawal period.

6.2. Cancellation of subscription

You may cancel the Subscription at any time through account settings at www.pacepilot.no or in the PacePilot app. If you cancel the Subscription, it expires at the end of the current billing period. If you have an active Trial Period and cancel before it ends, access will stop immediately.

6.3. Automatic renewal

If you do not actively cancel the Subscription before the renewal date, the Subscription is automatically renewed for one new billing period. You agree that we charge the subscription fee via your chosen payment method on the renewal date.

6.4. Termination by PacePilot

PacePilot reserves the right to terminate your Subscription if we reasonably believe the terms are not complied with, or if you do not live in a country where the Service is offered.

7. Use of the Service

7.1. Access to the Service

PacePilot provides a personal digital service that gives you access to training programs, AI-based coaching, analytics, and other relevant content directly in the app. You receive a limited, revocable, non-exclusive, non-transferable right to use the Service for your private purposes, in accordance with the Terms.

7.2. Technical requirements

To use the Service you need a compatible device (for example a smartphone) with internet access. You must also have downloaded the PacePilot app. From time to time we may ask you to upgrade the app to maintain security and improve the user experience.

7.3. Fair use

You agree to use the Service in accordance with applicable laws and good conduct. You must not:

  • A) use the Service in a way that is illegal, fraudulent, or harmful
  • B) attempt to disrupt, circumvent, or cause problems for the Service infrastructure
  • C) share username and password with others or otherwise give unauthorized persons access to the Service
  • D) copy, redistribute, sell, lease, or otherwise attempt to commercialize the Content without our written consent
  • E) abuse promotional and/or discount schemes (e.g. using Trial Periods multiple times)

Use in breach of this provision is considered material breach and may lead to immediate closure of your account and/or legal action.

7.4. User-generated content

If you share user-generated content in the Service (e.g. discussions with our AI coach or posts on social media related to Pace Pilot), you are responsible for ensuring that it does not infringe third-party rights or is otherwise offensive, harassing, or illegal. PacePilot reserves the right to remove such content.

8. Changes to the Service and intellectual property

8.1. Change or removal of content

Content in the Service may be updated, changed, or removed on an ongoing basis, for example to improve the user experience, comply with legal requirements, or respect third-party rights. Such changes do not in principle give grounds for compensation to you as a user, unless otherwise specifically agreed or required by mandatory law.

8.2. Copyright

All content in the Service—including text, video, audio, images, design, source code, or other material—belongs to PacePilot or our licensors and is protected by copyright and other intellectual property rights. You have no right to copy, distribute, or otherwise exploit the content without prior written consent.

9. Suspension and termination by us

9.1. Suspension of service

We may, without notice, temporarily suspend your access to the Service if you materially breach the Terms, or in cases of security breaches, risk of fraud, suspected illegal activity, and the like.

9.2. Termination by us

We may terminate the Agreement with immediate effect if you breach the Terms or applicable laws and regulations. Termination means you lose access to the Service without entitlement to a refund, unless mandatory law provides otherwise.

10. Limitation of liability

10.1. Availability

PacePilot strives to keep the Service available at all times but cannot guarantee that the Service is free from errors or interruptions. Planned maintenance, technical failures, or circumstances beyond our control may cause downtime.

10.2. Limitation of liability

If you are dissatisfied with the Service or the Content, your sole remedy is to cancel the Subscription. PacePilot is not liable for indirect loss, and our financial liability is in all cases limited to the amount you have paid for the Service in the twelve (12) months before a claim is made, unless otherwise required by mandatory law.

10.3. Third-party links

The Service may contain links to third-party websites or services. PacePilot is not responsible for the content on those websites or services.

11. Privacy

How we process your personal data is described in our privacy policy, which you can find at www.pacepilot.no. Where our processing requires your consent, we ask for it separately in the app, as described in the privacy policy.

12. Changes to the Terms

12.1. Notice of changes

We reserve the right to change the Terms when necessary, e.g. due to changes in legislation or the Service. If the changes are material and affect your rights or obligations, we will notify you at least 30 days before the new terms take effect. Continued use of the Service after the changes take effect is deemed acceptance of the updated Terms.

13. Governing law and dispute resolution

13.1. Applicable law

The Agreement is governed by and shall be interpreted in accordance with Norwegian law, unless otherwise required by mandatory law in the country where you have your permanent residence.

13.2. Dispute resolution

If you are dissatisfied with the Service, you may contact us at post@pacepilot.no. Complaints that are not resolved amicably may be brought before the Norwegian Consumer Authority (Forbrukertilsynet) if you are a consumer. Regardless, disputes may also be brought before the ordinary courts, with Sarpsborg District Court as venue, unless otherwise required by mandatory law.
